Please read the Eduvek Student Terms below. You accept them by completing and signing the confirmation.

These Terms and Conditions ("Terms") govern your use of Eduvek.com ("Eduvek", "we", "us") and your purchase of lessons, courses, workshops, and other educational services through the platform. By creating an account, purchasing any service, or otherwise using Eduvek, you ("you", "the Student") agree to be bound by these Terms. Please read them before purchasing. If you do not agree, do not use the platform.

1. About Eduvek

1.1 Eduvek operates a curated digital learning platform that connects students with independent instructors, tutors, coaches, and educational content.

1.2 Eduvek is a marketplace and booking platform. Instructors are independent contractors who deliver their own educational services; they are not employees or agents of Eduvek.

1.3 Eduvek reviews instructor applications and may verify credentials, but does not guarantee, certify, or endorse any instructor's qualifications, teaching quality, or the educational outcomes of any lesson or course.

1.4 Your relationship is with Eduvek. You acknowledge that your relationship is with the Eduvek platform rather than with any individual instructor.

2. Eligibility

2.1 Adults only. Eduvek is an adults-only platform. You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction if higher, to create an account or purchase any service. By using Eduvek you represent and warrant that you meet this requirement.

2.2 Eduvek does not knowingly provide services to minors. Where Eduvek becomes aware that an account holder is under eighteen (18), the account will be closed and any unused balance refunded in accordance with Section 11.

2.3 Accurate information. You agree to provide accurate, current, and complete information when creating an account and making purchases, and to keep that information up to date. You are responsible for keeping your email address current so that you receive lesson notifications and platform communications.

2.4 Account security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Accounts are personal to you and may not be shared.

2.5 Identity verification. Eduvek may require reasonable identity verification where necessary to prevent fraud, protect instructors, or comply with legal obligations.

3. Sanctions and Eligibility Restrictions

3.1 You represent and warrant that you are not located in, ordinarily resident in, or a citizen or national of any country, territory, or region subject to comprehensive economic sanctions, trade embargoes, or similar restrictions imposed by Canada, the United States, the United Kingdom, the European Union, the United Nations, or any other authority applicable to Eduvek or its payment providers.

3.2 This includes, without limitation, Cuba, Iran, North Korea, Syria, the Crimea region, the Donetsk region, and the Luhansk region, as such restrictions may be amended from time to time.

3.3 You further represent that you do not appear on, and are not owned or controlled by any party appearing on, any applicable sanctions, anti-money laundering, or restricted-party list.

3.4 Eduvek may refuse, suspend, or cancel any purchase or account where required to comply with applicable law, sanctions programs, or payment-provider requirements.

4. Purchases, Pricing, and Payment

4.1 Currency. All prices are displayed and charged in U.S. Dollars (USD) unless expressly stated otherwise at checkout.

4.2 Payment processing. Payments are processed by third-party providers (including Stripe and PayPal). By purchasing, you agree to those providers' terms in addition to these Terms.

4.3 Live tutoring. Your first purchase with any instructor is a single lesson, so that you can try that instructor before committing further. Once that first lesson has taken place and both you and your instructor have confirmed it, you may purchase further lessons with that instructor in blocks of hours. Purchased hours are credited to your balance and booked against that instructor's availability. This is explained in Section 5.2.

4.4 Validity of purchased hours. Purchased tutoring hours are valid for six (6) months from the date of purchase. Hours not booked and used within that period expire and are no longer available for booking or refund. Lesson credit arising under Section 7 is valid for six (6) months from the date the credit is issued.

4.5 Hours are held with one instructor. Hours you purchase are purchased in respect of the instructor you bought them for, and are used with that instructor. If you decide to work with a different instructor, you purchase a single lesson with them as described in Section 9, and any remaining unused and unbooked hours from your earlier purchase are dealt with under Section 11.

4.6 Courses and digital products. Recorded courses, workshops, e-books, and other digital products are purchased individually and grant you access as described in Section 10. Live group courses are governed by Section 10A.

4.7 Pricing changes. Eduvek may change prices at any time. Changes do not affect purchases already completed. Where an instructor changes their lesson price, hours you have already purchased are unaffected: they remain valid at the price you paid until they are used, refunded, or expire under Section 4.4.

4.8 Taxes. Prices may be exclusive of applicable taxes, which will be added at checkout where required.

4.9 Payment disputes and chargebacks. If you believe a charge is incorrect, you agree to contact Eduvek at info@eduvek.com to resolve the matter before initiating a chargeback or payment dispute with your bank or payment provider. Initiating a chargeback without first contacting Eduvek, or making a chargeback that Eduvek reasonably determines to be fraudulent or abusive, may result in suspension or permanent termination of your account and forfeiture of any remaining balance.

4.10 Purchases are personal to you. Purchased tutoring hours, lesson credit, group course places, and access to courses and digital products are personal to the account holder and are non-transferable. You may not sell, gift, assign, lend, share, or otherwise transfer them to any other person, including family members, friends, colleagues, or another Eduvek account. Lessons must be attended by the account holder, and course access may not be shared. Eduvek may suspend or terminate an account, without refund, where it reasonably determines that purchases or account access have been transferred or shared.

5. Placement, Booking, Confirmation, and Attendance

5.1 Placement test. Before your first lesson in a subject, you may be invited to complete a short online placement test so that your instructor understands your current level. The test is free of charge, you complete it independently on the platform, and it is not a live session with an instructor. You only need to take it once per subject area — your result applies across all instructors teaching that subject. Your instructor may see your result, score, and answers in order to prepare appropriate lessons. Completing a placement test is not a condition of booking a lesson.

5.2 Your first lesson with an instructor. Where you have not previously had a lesson with a particular instructor, your first purchase with that instructor is a single lesson. Once that lesson has taken place and both you and your instructor have confirmed it, you may purchase further lessons in blocks. This applies separately to each instructor. Your first lesson is a full, paid lesson: it is taught, paid for, and governed by these Terms in the same way as any other lesson, and it is not a free trial, sample, or assessment.

5.3 Lesson confirmation. Scheduled lessons are confirmed by both you and your instructor through the platform, no later than forty-eight (48) hours before the scheduled start time. A mutually confirmed lesson is a committed booking.

5.4 If you do not confirm. Where you do not confirm a scheduled lesson within the confirmation window, the booking is not cancelled: your instructor's time remains reserved, and the lesson continues to be governed by the cancellation and attendance provisions in Sections 6 and 7. Failing to confirm does not release you from those provisions, and you remain responsible for either cancelling within the twenty-four (24) hour window or attending the lesson.

5.5 Time zones. Lesson times are displayed according to the time zone set on your account. You are responsible for ensuring your time zone setting is correct and for verifying your local lesson time before each session.

5.6 Attendance. You are responsible for attending your confirmed lessons at the scheduled time, and for ensuring your own internet connection, device, and audio/video equipment are working before the lesson begins. If you do not join at the scheduled time, your instructor will wait for you for thirty (30) minutes before the lesson is treated as a missed lesson under Section 7.

5.7 Reporting the outcome. After each lesson, both you and your instructor confirm through the platform that the lesson took place. Confirming promptly helps ensure your records are accurate and your instructor is paid correctly. If neither party reports, Eduvek will follow up and may determine the outcome using the platform's session attendance records.

6. Cancellation and Rescheduling

6.1 The 24-hour window. You may cancel or reschedule a confirmed lesson free of charge by giving at least twenty-four (24) hours' notice before its scheduled start time. The lesson hour returns in full to your balance and your instructor's time is freed.

6.2 Late cancellation. A cancellation or rescheduling request made less than twenty-four (24) hours before the scheduled start time is a "Late Cancellation" and is subject to Section 7.

6.3 The twenty-four (24) hour window applies to all tutoring lessons, including your first lesson with a new instructor. Live group courses are governed separately by Section 10A.

7. Missed Lessons — The 50/50 Rule

7.1 Where you fail to attend a scheduled lesson within the thirty (30) minute wait window, disconnect before meaningful participation occurs, or make a Late Cancellation, and your instructor was present and prepared to teach:

(a) fifty percent (50%) of the lesson value is paid to your instructor, in recognition of the time they reserved and held for you;

(b) fifty percent (50%) of the lesson value is returned to you as lesson credit, which you may use to rebook;

(c) Eduvek retains no fee on this split; and

(d) no cash refund is issued in respect of the forfeited portion.

7.2 This rule applies regardless of the reason for your absence, including illness, emergencies, or scheduling conflicts, subject only to Section 7.3. It reflects the cost of not providing twenty-four (24) hours' notice.

7.3 Technical-failure exception. The 50/50 rule applies without exception to personal circumstances. The sole exception is a technical failure, as follows:

(i) Eduvek platform failure — automatic. Where a lesson cannot proceed because of an outage or failure of Eduvek's platform or video service, your lesson hour is restored in full at no cost. No evidence is required and neither party is penalised.

(ii) Your own technical failure — waiver on evidence. Where you are prevented from attending by a technical failure on your side (such as loss of internet connectivity, a power outage, or device failure), you may request that the 50/50 forfeiture be waived. Your request must be submitted within twenty-four (24) hours of the lesson's scheduled end time and supported by reasonable verifiable evidence, such as an outage notice from your internet or power provider. Requests are reviewed and granted at Eduvek's reasonable discretion. Where approved, your lesson hour is restored in full.

7.4 Eduvek maintains attendance records for each session, including participant join times and duration, and may rely on those records when reviewing any request under this Section.

7.5 Late arrival. Where you arrive late but within the thirty (30) minute window, your instructor may proceed with the lesson but is only required to teach until the end of the originally scheduled time.

8. If Your Instructor Reschedules or Does Not Attend

8.1 If your instructor reschedules. Your instructor may move a confirmed lesson to another available time before it begins. When this happens the lesson still takes place — only its time changes — and you are notified of the new time automatically. You are never charged for a reschedule, and your lesson hour is unaffected. If the new time does not suit you, you may reschedule or cancel it under Section 6 like any other confirmed lesson.

8.2 If your instructor does not attend. Your instructor is expected to join within fifteen (15) minutes of the scheduled start time. Where they join within that period, the lesson proceeds and they remain responsible for delivering the full lesson length, extending past the original end time where necessary. Where your instructor does not join within fifteen (15) minutes, cancels a confirmed lesson, or is otherwise unavailable without prior notice, you will not be charged. The lesson hour is restored in full to your balance and may be rebooked at your convenience. This applies regardless of the reason for the cancellation.

8.3 If your instructor becomes unavailable. Where your instructor leaves the platform, becomes unavailable, or is suspended, Eduvek may reassign you to another qualified instructor to maintain continuity of your learning, and will use reasonable efforts to identify a suitable replacement. This Section applies to live tutoring. A group course that has already formed is not reassigned to a different instructor; what happens in that case is set out in Section 10A.8.

9. Choosing and Changing Instructors

9.1 Live tutoring only. You are free to choose which instructor to book with. This Section applies to live tutoring only. It does not apply to recorded courses, workshops, digital products, downloadable content, or group courses.

9.2 Trying a different instructor. If your instructor is not the right fit, you may simply book a single lesson with a different instructor, as described in Section 5.2. There is no approval, request, or reassignment process, and there is no limit on the number of instructors with whom you may take a first lesson.

9.3 Your placement result carries across. If you have completed a placement test for a subject, you do not need to repeat it when you work with a different instructor in that subject.

9.4 What happens to hours you have already bought. Hours you have purchased are held with the instructor you bought them for, as set out in Section 4.5. Where you decide not to continue with that instructor, any remaining unused and unbooked hours may be dealt with under Section 11.

10. Courses and Digital Products

10.1 Access. Recorded courses, workshops, and digital products are delivered through the Eduvek platform. Unless expressly stated otherwise, purchased course content is accessed by streaming on the platform and is not provided as a downloadable file.

10.2 Duration of access. Unless expressly stated otherwise at the point of purchase, course access is granted on a one-time-purchase basis for the duration that the course remains available on the platform.

10.3 Availability. Eduvek uses reasonable efforts to keep purchased content available, but may remove, replace, or update content. Where content you have purchased is permanently removed, Eduvek will offer reasonable alternative access or a refund.

10.4 Live group courses. Live group classes, group workshops, and group coaching delivered to more than one student at the same time are not one-to-one tutoring and are governed by Section 10A.

10.5 Personal use only. Course content is licensed to you for your own personal, non-commercial educational use. You may not copy, download, record, screenshot, redistribute, resell, publish, share your account access, or make course content available to any other person.

10A. Live Group Courses

This Section governs live group courses. Group courses work differently from one-to-one tutoring, and the cancellation, refund, and attendance rules in Sections 6, 7, and 9 do not apply to them. Please read this Section before joining a group course.

10A.1 What a group course is. A group course is a set of live sessions taught to a group of students at the same level, over a defined number of weeks, at a fixed price per place. It has a set start, a set end, a set number of sessions, and a structured curriculum. Group courses are not delivered one-to-one.

10A.2 Placement. Some group courses are offered at more than one level. Where a course uses placement, you complete a placement assessment before joining so that you are placed at the appropriate level. Depending on the course, your result may be scored automatically or reviewed by the instructor, in which case you will be told when to expect your result. Some group courses have a single level and do not use placement at all; where that is the case, any requirements for the course are stated in the course listing, and you are responsible for deciding that the course suits you before joining.

10A.3 Before you join. Before confirming a place, you can watch the course introduction video and the instructor's introduction, read the course description and schedule, and complete the placement assessment where the course uses one. You are asked to confirm your place only after the group has formed. Please use this information to decide whether the course is right for you, because once the group has formed the fee is not refundable on the basis of a change of mind (see 10A.6).

10A.4 How a group forms. A group course runs only once a minimum number of students have joined for that level — currently five (5) — and a group may grow to a maximum, currently ten (10). Where more students wish to join than a group can hold, Eduvek may open an additional group at the same level. If a group does not reach the minimum within thirty (30) days of listing, or by an agreed target start date, Eduvek may cancel or postpone it and will let you know.

10A.5 When you pay. You pay the full course fee upfront, but payment becomes available only once the group has reached the minimum number of students, every student in the group has confirmed their attendance, and a start date has been set. You are never charged for a group course that has not yet formed and been confirmed. If a group never forms, you are not charged at all.

10A.6 Refunds. Because you decide whether to join with full information, and because a group course depends on a committed group who begin and progress together, the course fee is not refundable once the group has formed and the course has been confirmed. This includes a change of mind, not attending, or dissatisfaction with the pace, style, or subject matter of the course. If you leave a formed group, the course continues as scheduled for the remaining students.

A refund or transfer is provided only where the course does not proceed as promised — specifically where: (a) the instructor cancels the course; (b) the instructor is unable to deliver it; (c) the course differs materially from its description; or (d) a refund is required by law. Where this becomes apparent within the first session, you may choose to continue with the arrangement Eduvek offers, or to receive a refund for the part of the course not delivered.

10A.7 If you miss a session. Attendance is your responsibility. If you miss a session you remain entitled to the materials for that session, but the instructor is not required to repeat it, provide a private catch-up lesson, or give you individual instruction. Sessions are not recorded for catch-up, so a session you miss cannot be watched later. No refund or credit is issued for a session you do not attend.

10A.8 If your instructor misses a session. Where your instructor cannot deliver a scheduled session, that session is rescheduled and the course is extended so that you receive the full number of sessions you paid for. A rescheduled session may fall after the course's original end date. Group courses are taught by the instructor who offers them and are not transferred to a substitute instructor. Where an instructor cannot complete a formed course at all, Eduvek will refund you for the part of the course not delivered.

10A.9 Joining after the course has started. If you join a group course after it has begun, you pay the full course price and receive the materials for any sessions already held. No deduction is made for sessions that took place before you joined.

10A.10 If students leave. Where students withdraw and the group falls below the minimum after the course has started, the course may continue at Eduvek's discretion, and the remaining sessions are delivered as scheduled.

10A.11 Conduct in group courses. You are expected to behave respectfully toward your instructor and the other students. Eduvek may remove you from a group course without refund where you harass, discriminate against, or abuse others, repeatedly interrupt teaching, share inappropriate content, attempt to contact students or instructors off the platform, or otherwise interfere with the group's learning. Removing one student does not affect the course for everyone else.

10A.12 Recording. Eduvek may occasionally record parts of group sessions for marketing and promotional purposes, and will give notice when it does. Eduvek does not record every session. You may not record, share, sell, or distribute any session yourself without written permission from Eduvek and the instructor.

10A.13 Certificates. Some group courses offer a certificate of completion. Where one is offered, this is stated in the course listing before you purchase, along with the attendance you need to earn it. You earn a certificate by attending at least 80% of the sessions available to you. If you join a course after it has started, only the sessions from your join date onward are counted — so joining at the fourth session of sixteen means you are assessed on thirteen. A session counts as attended if you were present for at least half of it. Your instructor confirms each session and records who attended, and certificates are issued once those records are complete. A certificate confirms participation or completion only; it is not a professional qualification or academic credit.

11. Refunds

11.1 Unused tutoring hours. Your first purchase with any instructor is a single lesson, so you are not asked to commit to a block of hours before deciding whether an instructor suits you. Where you have gone on to purchase a block of hours and later decide not to continue, you may request a refund of any hours that are both unused and unbooked. Such requests are assessed and processed manually by Eduvek, at Eduvek's discretion.

11.2 Exclusions. Refunds are not available for:

  • lessons already delivered, including your first lesson with an instructor;
  • hours that are currently booked;
  • the fifty percent (50%) forfeited portion of a missed lesson or Late Cancellation under Section 7;
  • expired hours or expired lesson credit under Section 4.4;
  • group course fees once the group has formed and the course has been confirmed, except as set out in Section 10A.6;
  • course or digital product purchases where access has already been granted, except as provided in Section 10.3.

11.3 Completed lessons. Once a lesson has been substantially delivered, a refund will not ordinarily be granted solely because you are dissatisfied with the pace, teaching style, difficulty, or subjective outcome of the lesson. Eduvek reviews exceptional circumstances case by case, including verified technical failures, instructor misconduct, safety concerns, or a material failure to deliver the service described.

11.4 Processing fees. Where a refund is approved, Eduvek may deduct non-refundable payment-processing fees, currency-conversion fees, or similar third-party transaction costs actually incurred. Such deductions recover actual costs only and are not a penalty or Eduvek revenue. This means a refunded amount may be less than the amount originally charged.

11.5 Abuse of the refund policy. Repeated or excessive refund requests, or patterns of conduct that Eduvek reasonably determines to be an abuse of its refund, credit, or cancellation policies, may result in suspension or permanent termination of your account.

11.6 Eduvek's determination on refund requests is final.

12. Student Conduct and Responsibilities

12.1 General. You agree to treat instructors and other users with respect and professionalism, and to conduct yourself appropriately during all lessons and communications.

12.2 Your responsibilities. You agree to:

  • attend lessons punctually and prepared;
  • participate from an environment reasonably free from excessive noise, distraction, or interruption;
  • use respectful and appropriate language;
  • complete placement tests, assessments, and exercises honestly and without assistance;
  • follow your instructor's stated policy regarding the use of AI tools in lessons or assignments, and not submit AI-generated work as your own for a placement test or any assessed exercise unless the instructor or course listing expressly permits it. Where Eduvek reasonably determines that a placement result was produced with AI assistance or other outside help, it may void the result and ask you to retake the test;
  • keep your account and contact details current.

12.3 Prohibited conduct. You must not:

  • harass, threaten, abuse, discriminate against, or behave inappropriately toward any instructor, student, or Eduvek staff;
  • engage in sexual misconduct or share sexually explicit material;
  • attend lessons while impaired in a manner that prevents the lesson proceeding;
  • record, screenshot, or capture any lesson, instructor, or participant without their express consent and Eduvek's authorisation;
  • share your screen in a way that displays other people's personal information, confidential material, or content inappropriate to the lesson;
  • use automated means to scrape, mine, copy, or extract course materials, placement test questions, instructor profiles, or any other content from the platform;
  • misrepresent your identity, age, or eligibility;
  • use the platform for any unlawful purpose.

12.4 Consequences. Where you engage in prohibited conduct, your instructor may end the lesson immediately, and Eduvek may suspend, restrict, or permanently terminate your access to the platform. Where a lesson is ended early due to verified misconduct on your part, no refund or credit is issued for that lesson.

12.5 Bookings and payments through Eduvek. All bookings, scheduling, lessons, communications, and payments relating to services introduced through Eduvek must take place through Eduvek's approved channels.

12.6 Non-circumvention. During your use of Eduvek and for a period of twelve (12) months following your last lesson booked through the platform, you agree not to engage, retain, or pay any instructor introduced to you through Eduvek for educational services outside the platform. Without limiting this, you must not:

  • arrange lessons with an Eduvek instructor through personal email, telephone, or messaging applications;
  • pay an instructor directly by any method, including bank transfer, e-transfer, cash, or third-party payment services;
  • solicit an instructor to teach you outside Eduvek.

This restriction does not apply where you were already a direct client of that instructor before being introduced through Eduvek. Circumventing the platform is a material breach of these Terms and may result in immediate termination of your account without refund of any remaining balance.

13. Recording, Monitoring, and Privacy

13.1 Session records. Eduvek records attendance for every lesson and group session. For one-to-one lessons this includes participant join times and duration recorded by the video platform. For group courses, your instructor confirms that each session took place and records which students attended. This information is used to verify delivery, resolve disputes, calculate instructor payments, and determine eligibility for course certificates.

13.2 Placement test records. Where you complete a placement test, Eduvek retains your responses, score, and resulting level. Your instructor may view these in order to prepare appropriate lessons. Placement results are not published and are not shared with other students.

13.3 Quality assurance. To maintain quality and safety standards, Eduvek may observe lessons, make or request recordings, review communications conducted through Eduvek systems, and investigate complaints, with appropriate notice to participants.

13.4 Your consent to recording. Where a lesson or group session is to be recorded, you will be notified in advance. By continuing with a recorded session you consent to that recording being made and used for the purposes described in these Terms.

13.5 No unauthorised recording by you. You must not record, screenshot, or otherwise capture a lesson, your instructor, or any participant without their express consent and Eduvek's authorisation.

13.6 Personal information. Eduvek collects, uses, and discloses your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Eduvek's Privacy Policy. By using the platform you consent to that collection and use.

13.7 Retention. Eduvek retains transaction records, lesson records, placement results, and acceptance records for as long as reasonably necessary for legal, tax, accounting, audit, and dispute-resolution purposes.

14. Reviews and Feedback

14.1 You may leave reviews and ratings of instructors and courses. Reviews must be honest, respectful, and based on your genuine experience of the service.

14.2 Eduvek may remove or decline to publish any review that is abusive, defamatory, discriminatory, fraudulent, misleading, or unrelated to the educational service provided.

14.3 Ownership. All reviews, ratings, testimonials, comments, and feedback submitted through the Eduvek platform are and remain the property of Eduvek. Eduvek may display, edit for length or formatting, translate, archive, and use such content for quality-assurance and promotional purposes, in any medium and in any market. To the extent permitted by law, you waive any moral rights you may hold in the content you submit, so that it may be edited and translated for these purposes.

14.4 You must not manipulate reviews, submit false reviews, or accept any incentive in exchange for a review.

15. Intellectual Property

15.1 All content on the Eduvek platform — including course materials, lesson materials, placement tests, text, video, graphics, branding, and software — is owned by Eduvek or its instructors and is protected by copyright and other intellectual property laws.

15.2 Your purchase grants you a limited, personal, non-transferable, non-exclusive licence to access and use the content for your own educational purposes. It does not transfer ownership of any content to you.

15.3 You may not reproduce, distribute, publish, resell, sublicense, or create derivative works from any Eduvek or instructor content without express written permission. This includes placement test questions and answers.

16. Limitation of Liability

16.1 Eduvek provides a marketplace and booking platform. Eduvek is not responsible for educational outcomes, examination results, employment outcomes, certification outcomes, or the performance of any instructor.

16.2 Eduvek does not guarantee uninterrupted access to the platform and is not liable for disruptions resulting from internet outages, third-party service failures, hosting issues, software defects, cybersecurity incidents, maintenance, or events beyond its reasonable control. Eduvek may temporarily suspend access for scheduled maintenance, security updates, or system improvements.

16.3 To the maximum extent permitted by law, Eduvek shall not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or opportunities, arising from your use of the platform.

16.4 To the maximum extent permitted by law, Eduvek's total liability to you in respect of any claim is limited to the amount you paid to Eduvek in the six (6) months preceding the event giving rise to the claim.

16.5 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Force Majeure

Eduvek shall not be liable for any delay or failure in providing the platform or educational services where such delay or failure results from events beyond its reasonable control, including natural disasters, severe weather, acts of government, war, terrorism, civil unrest, labour disputes, power failures, widespread internet or telecommunications outages, pandemics, cyberattacks, or the failure of third-party service providers. Eduvek will make reasonable efforts to resume services as soon as practicable and, where a lesson is affected, to reschedule or restore the affected lesson hour.

18. Indemnification

You agree to indemnify and hold harmless Eduvek from any claims, losses, liabilities, damages, costs, or expenses arising from your use of the platform, your conduct, your breach of these Terms, or your violation of any law or the rights of any third party.

19. Suspension and Termination

19.1 Eduvek may suspend or terminate your access to the platform immediately where you breach these Terms, engage in prohibited conduct, misrepresent your eligibility, abuse the refund or chargeback process, attempt to circumvent the platform, or where required by law.

19.2 Where your account is terminated for misconduct or circumvention, no refund of unused hours, group course fees, or purchased content is owed.

19.3 You may stop using the platform at any time. Unused, unbooked hours may be refundable in accordance with Section 11, provided they remain within the six (6) month validity period set out in Section 4.4. Hours that have already expired under Section 4.4 are not refundable.

20. General Provisions

20.1 Entire agreement. These Terms, together with Eduvek's Privacy Policy and any policies expressly incorporated by reference, constitute the entire agreement between you and Eduvek concerning your use of the platform, and supersede any prior understanding.

20.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

20.3 No waiver. Eduvek's failure to enforce any provision of these Terms does not constitute a waiver of that provision or of any other provision.

20.4 Assignment. You may not assign or transfer your rights under these Terms without Eduvek's written consent. Eduvek may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of assets.

20.5 Language. Unless otherwise stated, Eduvek's platform policies, customer support, legal notices, and official communications are provided in English. Where these Terms are translated, the English version governs in the event of any inconsistency.

20.6 Electronic acceptance. You agree that your electronic acceptance of these Terms has the same legal effect as a handwritten signature, and that records of your acceptance maintained by Eduvek are admissible evidence of that agreement.

20.7 Notices. Eduvek may provide notices to you by email to the address on your account or by posting on the platform. You are responsible for keeping your email address current.

21. Changes to These Terms

21.1 Eduvek may update these Terms from time to time. The version in force at the time of your purchase governs that purchase.

21.2 Where changes are material, Eduvek will notify you and may require your renewed acceptance before you continue to use the platform or make further purchases.

22. Governing Law

22.1 These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

22.2 Any disputes shall be resolved in Ontario, Canada.

22.3 Talk to us first. Before starting formal proceedings, you agree to raise the matter with Eduvek in writing at info@eduvek.com and to allow thirty (30) days for it to be resolved informally. Nothing in this Section prevents either party from seeking urgent relief where necessary, or affects any right you have to bring a complaint to a consumer-protection or regulatory authority.

23. Acceptance

23.1 By accepting these Terms electronically at the time of purchase, you confirm that you have read them, understand them, and agree to be legally bound by them.

23.2 You further confirm that the following details are true, accurate, and complete, and you undertake to notify Eduvek promptly of any change:

23.3 Purpose of these details. Your name identifies you as a party to these Terms. Your email address is used for lesson notifications, booking confirmations, receipts, and platform communications. Your telephone number is used to contact you where a lesson or booking issue cannot be resolved by email, and for account security and verification purposes. Your country of residence is used to confirm eligibility under Section 3 and to meet Eduvek's legal and payment-compliance obligations. These details are handled in accordance with Section 13 and Eduvek's Privacy Policy.

23.4 Record of acceptance. Eduvek records the date and time of your acceptance and the version of these Terms accepted. These details are provided by you at the time of acceptance and form part of these Terms.
